Abacus Domain Name and hosting plan terms

Abacus has a 30 day money back guarantee for all hosting accounts. 

Abacus - Hosting Termination and Cancellation Policy

Cancellation requests must be made via email to billing@abacuswebhosting.com. Fees paid for service to the point of cancellation are nonrefundable. Hosting cancellations made within 30 days of beginning service are subject to the Abacus 30-day guarantee, and will result in a refund of hosting fees paid (Domain Name fees non refundable).

Domain registrations are non refundable.

Hosting Accounts are payable in full at the time of account creation. Hosting Accounts for which payment by credit card is selected are subject to suspension if payment cannot be processed at the time of account creation. Any account reaching fifteen (15) days past due is subject to suspension for nonpayment. Such accounts will be terminated after thirty (30) days in a delinquent state. All invoicing and payments are automatic and recurring based on the contract length specified by the client at the time of account setup or by request after setup has been completed. All invoices are due upon creation/ receipt. Charge backs issued for valid hosting fees will result in immediate account termination, without prior notice, and without exception.

Abacus - Hosting Acceptable Use Policy

The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users. Our acceptable use policy is actively and strictly enforced. We reserve the right to determine what constitutes acceptable use. Violations will result in immediate deactivation of services and removal from our network without refund, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. If you are unsure about content you intend to place on our network, please check with us before you do. Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Important - Abacus does not allow the use of game servers or sites with pornographic content.

Illegal Activity

Engaging in activities that are determined to be illegal, including advertising, transmitting, pyramid schemes, fraudulently charging credit cards, and pirating software.

Undesirable Content

Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work. Copyrighted Media can not be publicly distributed.

Inappropriate E-Mail Activity

Commercial E-mail - Defined as sending unsolicited commercial e-mails. This is prohibited. You are not permitted to use your Hosting account or e-mail alias/account of your Virtual Server to send unsolicited commercial e-mail. Using an e-mail address hosted anywhere on our servers to collect responses from unsolicited commercial e-mail is prohibited. This also includes using third party e-mail accounts or servers including free ones to promote spam. Please note we subscribe to Spam Cop services to monitor all inappropriate email activity. Mail Bombing - Defined as sending large volumes of unsolicited e-mail to individuals from your Abacus based Virtual Server account. This is strictly prohibited. Harassment - Defined as sending threatening or harassing e-mail after being requested to stop, is prohibited. Extremely threatening or harassing e-mail never is allowed. Forging of Headers - Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Inappropriate Newsgroup Activity

Newsgroup Spamming - Defined as excessive cross-posting, or posting the same article to several newsgroups. This is prohibited. Generally accepted standards allow no more than 15 newsgroups, or cross-postings, for a single article or substantially similar articles. Such articles may be canceled. You are not allowed to use your Abacus based mail facilities to SPAM the newsgroups. Off topic or inappropriate postings - There is no restriction on content, except as defined by each newsgroup. Continued posting of off-topic articles is prohibited. Please note that commercial advertisements are off-topic in the vast majority of newsgroups. If an Abacus customer is found to be spamming we will take action immediately. If we find that you have violated our No-SPAM Policy, we will disable your account and report you and the incident to the proper local, state, and federal authorities if necessary.

Misuse Of Resources

Some of our accounts come with their own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning. Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy, IRC bots and mailing list scripts are not allowed on our network under any circumstances. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP message forum, if possible (included with account).

Intellectual Property Violations

Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. Abacus is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringement. It is also our policy to terminate the privileges of customers who commit repeat violations of copyright laws.

Obscene Speech or Materials

Using Abacus network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. Abacus Pages is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through it's network. 

Illegal or Unauthorized Access to Other Computers or Networks

Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities

Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.

Hosting Terms

Abacus, referred to as "?Abacus LLC?" or "Abacus Web Hosting.com" at its sole discretion, may change the terms, conditions and operation of this website (the "Site") at anytime. By using this service the user agrees to the terms of this disclaimer and further waives any rights or claims it may have against Abacus, LLC.

The content available through the Site is the sole property of Abacus or its advertisers, suppliers or licensors and is protected by patent, copyright, trademark and other intellectual property laws. Except as otherwise explicitly agreed in writing, Abacus LLC-owned content received through the Site may be downloaded, displayed, reformatted and printed for your personal, non-commercial use only. Content owned by Abacus advertisers, suppliers or licensors may be subject to additional restrictions. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the content received through the Site to anyone, including but not limited to others in the same company or organization without Abacus's express prior written consent.
